Welcome to the website of Gentlecare Therapy LLC (“GentleCare Therapy,” “GentleCare,” “we,” “us,” or “our”), located at https://gentlecaretherapy.com/ (the “Website”). GentleCare provides Applied Behavior Analysis (ABA) therapy, speech therapy, occupational therapy, and related pediatric developmental and early intervention services in New Jersey and the Greater Philadelphia area.
These Terms & Conditions (“Terms”) govern your access to and use of the Website, including its content, forms, scheduling tools, resources, and job application features. By accessing or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.
1. Eligibility and Use of the Website
The Website is intended for adults — including parents, guardians, caregivers, referring professionals, and job applicants — who are at least 18 years old. The Website is not directed to children under 13, and children should not submit information through the Website. Parents and guardians may submit information about their children for intake purposes, as described in our Privacy Policy. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Website for your personal, non-commercial, informational purposes.
2. No Medical Advice; No Provider–Patient Relationship
The content on the Website — including descriptions of ABA, speech, and occupational therapy, blog posts, FAQs, autism resources, and parent workshop materials — is provided for general informational and educational purposes only. It is not medical, clinical, behavioral, psychological, or other professional advice, and it is not a substitute for diagnosis, evaluation, or treatment by a qualified professional. Every child is different; outcomes described on the Website are not guaranteed.
Using the Website, submitting a form, scheduling a phone consultation, or communicating with us by email does not create a provider–patient or clinician–client relationship. That relationship begins only after intake and assessment are completed and we have agreed in writing to provide services. Always seek the advice of your child’s physician or another qualified provider with questions about a medical or developmental condition, and never disregard professional advice or delay seeking it because of something you read on the Website.
3. Emergencies
The Website, our forms, and our email are not monitored for emergencies. If you or your child are experiencing a medical or mental health emergency, call 911 or go to the nearest emergency room. For a mental health crisis, you may also call or text 988 (Suicide & Crisis Lifeline).
4. Services, Intake, Scheduling, and Insurance
Information on the Website about our services, locations, service areas, hours, program availability (including statements about “immediate openings” and services that are “coming soon”), timelines (such as typical intake timeframes), and insurance participation is provided for general information, may change without notice, and does not guarantee the availability of any service, clinician, schedule, or start date. Submitting an intake form or scheduling a consultation does not guarantee enrollment or services. Services are subject to assessment, clinical appropriateness, staffing, insurance verification and authorization, and execution of our client agreements and consent forms, which will govern the services we provide. If there is a conflict between these Terms and a signed client agreement, the signed agreement controls with respect to services.
While we accept many commercial and Medicaid plans, including NJ FamilyCare, coverage depends on your specific plan and payer determinations. You remain responsible for understanding your benefits and for any amounts not covered by insurance, as set out in our client financial policies.
5. Health Information and Privacy
Our collection and use of information through the Website is described in our Privacy Policy. Protected Health Information (“PHI”) is governed by the Health Insurance Portability and Accountability Act (“HIPAA”) and our Notice of Privacy Practices, which is provided to clients at intake and is available on request from our Privacy Officer, Torrie Martin, COO, at info@gentlecaretherapy.com or (856) 484-5535. The Website, our Privacy Policy, and these Terms do not replace our Notice of Privacy Practices.
Please do not submit PHI through our general Contact Us form, job application forms, website email links, text messages, blog comments, or social media. Provide only the information requested on our Client Intake Form, which is designed for intake. You are responsible for information you choose to send through unsecured channels.
6. Communications Consent (Email, Calls, and Texts)
GentleCare Therapy sends text messages to clients, families, and job applicants. By submitting your contact information through the Website, you agree that we may contact you by email, phone, or text message to respond to your inquiry, conduct intake, schedule appointments or consultations, and communicate about services or your application. Where you expressly consent, you agree to receive calls and text messages, which may be sent using automated technology or prerecorded voice, at the number you provide, including for informational and, if you separately agree, promotional purposes. Consent to receive calls or text messages is not a condition of any purchase, service, or employment. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts and HELP for help. You may opt out of marketing emails using the unsubscribe link in any such email. Additional details are in our Privacy Policy.
7. Job Applications
Job postings and descriptions of benefits, pay, schedules, and other terms of employment on our “Join Our Team” page and other pages are informational, may change at any time, and do not constitute an offer or contract of employment. Submitting an application does not guarantee an interview or employment. You agree that the information you submit is accurate and complete and that it is your own. Employment offers, if any, will be made in writing and may be conditioned on verification of credentials, licensure or certification, background checks, and clearances as permitted or required by law. Our handling of applicant information is described in our Privacy Policy.
Equal Opportunity Employer. GentleCare Therapy is an equal opportunity employer. We do not discriminate in hiring or employment on the basis of race, creed, color, religion, national origin, ancestry, nationality, sex, pregnancy, sexual orientation, gender identity or expression, age, marital or domestic partnership or civil union status, disability, genetic information, military or veteran status, or any other characteristic protected by federal, New Jersey, or Pennsylvania law. Applicants who need a reasonable accommodation during the application process may contact us at info@gentlecaretherapy.com or (856) 484-5535.
8. Acceptable Use
You agree not to:
- use the Website for any unlawful, fraudulent, or harmful purpose, or in violation of these Terms;
- submit false or misleading information, impersonate any person, or submit information about another person without authority to do so;
- upload viruses, malware, or other harmful code, or interfere with or disrupt the Website, its servers, or its security features (including CAPTCHA);
- attempt to gain unauthorized access to any portion of the Website, our systems, or other users’ information;
- use robots, scrapers, or other automated means to access, copy, or collect content or data from the Website without our written permission;
- send spam, unsolicited advertising, or harassing, threatening, defamatory, obscene, or discriminatory content; or
- copy, modify, distribute, or create derivative works of the Website except as permitted in these Terms.
We may suspend or restrict access to the Website for any violation of these Terms.
9. Your Submissions
You are responsible for the information, files, and content you submit through the Website (“Submissions”) and represent that you have the right to submit them. Except for PHI and personal information, which we handle in accordance with HIPAA, our Notice of Privacy Practices, and our Privacy Policy, if you send us feedback, suggestions, or ideas about the Website or our services, you grant us a non-exclusive, royalty-free, perpetual right to use them without compensation or obligation to you.
10. Intellectual Property
The Website and its content — including text, graphics, logos, the GentleCare Therapy name and marks, photographs, videos, workshop materials created by GentleCare, and the selection and arrangement of content — are owned by or licensed to Gentlecare Therapy LLC and are protected by United States copyright, trademark, and other intellectual property laws. You may view and print content for your personal, non-commercial use, provided you keep all copyright and proprietary notices intact. You may not otherwise reproduce, distribute, modify, publicly display, or use our content or marks without our prior written permission. Third-party resources linked from the Website (for example, materials from government agencies or autism organizations) remain the property of their respective owners.
If you believe content on the Website infringes your copyright, please send a notice to our designated copyright agent, Torrie Martin, COO, Gentlecare Therapy LLC, 88 Lakeview Drive S, Gibbsboro, NJ 08026, info@gentlecaretherapy.com, (856) 484-5535, that includes a description of the work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that you are authorized to act on the owner’s behalf.
11. Third-Party Links, Resources, and Tools
The Website includes links to third-party websites and resources (such as Pennsylvania Early Intervention programs, the CDC, and autism organizations), our social media pages, and embedded third-party tools such as online forms and an online scheduling widget. We provide these for convenience; we do not control and are not responsible for third-party content, products, services, availability, or privacy practices, and a link does not imply endorsement. Your use of third-party sites and tools is subject to their own terms and privacy policies.
12. Accessibility Statement
GentleCare Therapy is committed to ensuring that our Website is accessible to everyone, including individuals with disabilities, consistent with the Americans with Disabilities Act (ADA), Section 1557 of the Affordable Care Act, and the New Jersey Law Against Discrimination. We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, and we review the Website periodically to identify and address accessibility barriers.
Some content and tools on the Website are provided by third parties (such as embedded forms, scheduling tools, and linked documents) and may not be fully within our control; we work with our vendors to improve accessibility where possible.
Need help? If you have difficulty accessing any content or feature of the Website, or need information in an alternative format, please contact us at (856) 484-5535 or info@gentlecaretherapy.com. Please describe the page and the problem you encountered, and we will make reasonable efforts to provide the information or service you need through an alternative means and to respond within five (5) business days.
13. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES, OR THAT CONTENT IS COMPLETE, ACCURATE, OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. This Section applies only to your use of the Website and does not limit any rights or obligations under a signed client agreement for services.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GENTLECARE THERAPY AND ITS OWNERS, OFFICERS, EMPLOYEES, CLINICIANS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE WEBSITE OR ITS CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or fraud, or any rights you may have under New Jersey consumer protection laws. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. This Section applies to your use of the Website only and does not govern professional services, which are subject to our client agreements and applicable law.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless GentleCare Therapy and its owners, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Website, or your violation of any law or the rights of a third party.
16. Governing Law and Venue
These Terms and any dispute arising out of or relating to them or the Website are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules, and by applicable federal law. You agree that any action relating to these Terms or the Website shall be brought exclusively in the state courts located in Camden County, New Jersey, or the United States District Court for the District of New Jersey, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim in another forum. These Terms do not require arbitration of any dispute.
17. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted on this page with a revised “Last Updated” date. If we make material changes, we may provide additional notice on the Website. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms. We may also modify, suspend, or discontinue any part of the Website at any time.
18. General Provisions
These Terms, together with our Privacy Policy and any additional terms referenced on the Website, are the entire agreement between you and GentleCare regarding the Website (signed client agreements govern services). If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. Headings are for convenience only. Provisions that by their nature should survive termination will survive.
